This is one of the first things I teach in my class.

One student wanted the domain name, "I Quit.com" even though it would have no searches for it and she would have to build all of her traffic. On checking, turns out the phrase, I Quit was trademarked but not being used. She even tried to contact the owner to buy the name but to no avail.

Trade mark search and business use searches should be the first step to check out before ordering the domain name.

Also, consider checking the Canadian and other trademarks.

Yes They Can! Any Big Company can force your hand THEIR 'Trade' name variation. It's part of the CyberBully Act passed by U.S. Congress. The penalty is $100,000 plus, plus, plus. Before you get in to deep (cisco-Er's), do a URL redirect. Then make the Redirected URL your primary. Been there, Got a T-Shirt!

What happens if you want a .com name and it is not trademarked, can you trademark it and then stop the .com from using it because it is yours. Can you then get that .com

In many of these domain name dispute cases under the ICANN UDRP, what it comes down to, is whether the Panel thinks you registered the domain name to take advantage of the trademark owner, or not. It is essentially a "smell test". So, put yourself in the shoes of an domain name dispute panelist or a domain name dispute attorney, and consider whether you would award the domain name to the trademark owner, or to the registrant.

I have a similar question here. I own the domain name cisco-tips.com and also ciscoasa.com which are blog websites. Can Cisco force me to shut them down because I use the word "Cisco" in the domain name?

I appreciate your feedback on my question

Thanks

Hi Nolo,

Actually i didnt undestand the problem here. if i legally bought the domain name (in my case cisco-networkers.com) i can use it for free (community site, shop for equipment etc). Cisco cant ask me to close the site because i use the registered word (Cisco - also name of fish) in my domain name. am i right?

is it possible to register cisco-networkers as trademark?

best regards
Oleg

It's extremely important to attempt the trademarking of your domain name. I just went through a nightmare situation that could have been avoided by getting the trademark first.
